Welcome to the premiere issue of "AWT Insights", AWT's monthly newsletter, a new source of expert commentary and insight into current trends in the maritime industry. In each newsletter, experienced AWT staff members and others will provide insights on key issues and trends shaping the industry. Earlier this year, I became the president and CEO of AWT, after nearly 30 years of executive-level management experience. From my position, I hear of concerns and am aware of intriguing issues in the industry. One concern occasionally expressed relates to the information AWT generates in our End of Voyage reports. Is the information we provide unbiased and independent? Allen Webb, a 30-year veteran of the marine industry and chairman of AWT-Europe, addresses this issue in his article. Charter Party agreements present other issues central to the shipping business. How they are interpreted regarding ship performance is a critical concern. In his article, "No Good Weather," Jim Sigafoose, marine claims specialist for 32 years on speed and consumption issues and forensic studies, addresses key points in the Charter Party as it concerns both owners and charterers. What Price Independence? by Allen Webb Who is independent? Charter Parties often contain some phrase stating, for example, "Evidence of weather conditions are to be taken from the vessel's deck logs and the reports of an independent weather bureau." And that, "In the event of any discrepancy between the deck logs and independent weather bureau, then the independent weather bureau reports are to be taken as ruling." |

Is AWT Independent? It has been argued, incorrectly, that any body or party appointed by another cannot be regarded as independent. Many owners and charterers have attempted to use this argument in defence against the use of AWT data. Of course, AWT is not independent if the criteria for the description of the word "independent" is taken to be whether or not a party has been appointed by another party, but this misses the point that the data used by AWT is independent data. It is not "AWT data" but independent verified data. Therefore, the term "independent" is most certainly covered in this respect. All AWT data is independent and entirely derived from independent sources such as direct satellite measurements. read more >
No Good Weather by Jim Sigafoose Charter Party speed and consumption warranties will nearly always be qualified as applying only to periods of a particular set of environmental conditions which define 'good weather'. At a recent workshop on Shipping Operational Disputes in Beijing, hosted by AWT, the following question was posed to the assembled panel which included experienced London arbitrators and legal experts in maritime issues: "In the case of good weather conditions being well-defined in the Charter Party agreement, but it occurs that during the voyage there are no good weather conditions as defined, is there then no obligation on the owners to conform to any level of speed and consumption?" In many circumstances it would indeed be the case that no claim for a breach of the Charter Party terms could be made, as there would be no measure available to determine this. read more > |
